TO William Briggs, Margaret Gulliver, Rebecca Nomis, Emily Mooney,
Eliza Rusell, Ann Franklin, Lydia Cragin, Mary Winslow*, Edwin R. Briggs,
George Briggs, William Briggs, Richard Briggs, Julia Briggs, Jacob Briggs,
Abraham Briggs, Jane E. Briggs
WHEREAS, George Briggs late of the town of Rhinebeck in the county of Dutchess,
deceased as is alledged has lately died, leaving a last Will and Testament relating
to real and personal estate; and Eliza Rusell wife of Isaac F. Rusell formally
Eliza Briggs Executing therein named had applied to the Surrogate of said county
for the proof thereof; You are hereby CITED to appear at a Surrogate's Court to
be held May A.D. 1861, at ten o'clock in the forenoon of that day, then and there to
attend the Probate of the last Will and Testament of said deceased.

Dutchess County, John L Green of Rhinebeck in said county depose and say, that he
served the within Citation on the 30th day of April 1861 of Ann Franklin, Lydia Cragin,
Edward R Briggs, William Briggs, Richard Briggs, Julia Briggs, Jacob Briggs, Abram Briggs,
Jane E. Briggs, and on this 1 day of May 1861 on Mary Windslow, and on May 3, 1861 on Rebecca
Nomis, on May 1 1861 on Emily Moony, Eliza Rusell, and George Briggs therein named,
by delivering a copy thereof to each personally, and at the same time showing to
them the within Citation.
STATE OF ILLINOIS, Cook County.
David C. Wagn of the city of Chicago being duly sworn, doth depose and say, that he
served the within Citation on the 27th day of April 1861 on William Briggs.
STATE OF ILLINOIS, Kam County.
J.H. Maybron of Geniva being duly sworn doth depose and say, that he served the within
Citation on the 30th day of April 1861 on Margaret Gulliver.
Guardianship:
In the matter of Proving the last Will and Testament of George Briggs deceased.
I, James Smith of the city of Poughkeepsie in the County of Dutchess, do hereby consent
to be appointed by the Surrogate of said County the guardian of Elizabeth Jane
Briggs, Abram Briggs and Jacob Briggs (children of Richard Briggs deceased) for the
sole purpose of appearing for them and taking care of their interests in proving the
last Will and Testament of said deceased.

Letter from Isaac F. Russell to Surrogates Court Dutchess County on the
matter of the estate of George Briggs deceased.
I, Isaac Rusell of the town of Rhinbeck in the county of Dutchess, husband
of Eliza, formerly Eliza Briggs, do hereby consent that my wife the said Eliza be appointed
an Executor of the last Will & Testament of George Briggs deceased,
she having been nominated as such executing in the last will and testament of said
deceased, and that letters testamenting of the said will and testament issue to the
said Eliza Rusell, and that she takin upon herself the burden of the execution thereof.
Dates this 18th day of May AD 1861.

Will of George Briggs:
I, George Briggs of the town of Rhinebeck in the county of Dutchess considering the
uncertainty of this mortal life do make and publish this my last Will and Testament
in names and from following that into say First I, will and dinct that all my debts
and funeral expenses be first paid out of my estate.
Second I, give grant bequeth and devise unto my daughters Eliza Briggs and Emily Briggs
all the rest and resident of my personal and real estate of every name and
description and wheresoever situates? to have and to hold the same as tenants in common
share and share alike forever.
Third I, hereby constitute and appoint my said daughters Eliza and Emily executives
of this my last will and testament, hereby revoking all former wills by me made
in witness whom of I have into set my hand and seal this 14th day of July in the year of our
Lord one thousand eight hundred and fifty seven.

The above instrument was at the date then of signed in our presence by the Estator
George Briggs who is well known to us, and we at his request here to have set our names as
subscribing witnesses and at the same time he did and to us that the same was his
last will and testament.

State of New York Dutchess Surrogate court to Peter Borland Esq. surrogate of County
of Dutchess. The petition of Eliza Rusell of the town of Rhinebeck in the county of
Dutchess respectfully showth that George Briggs late of the said town of Rhinebeck
departed this life in said town on or about the 17th day of October 1851 having ?
? ? petitioner is informed and ? duly made and executed his last will and testament.
That your petitioner is one of the executors named in said will. That he was at or
immediately previous to his death an inhabitant of said County of Dutchess, and that
his said will relates to both real and personal estate.
Your petitioner further shows that the kins and next of kin of the said deceased on his
11 children to will, William Briggs and Margaret Gullion both of Chicago in the State
of Illinois, Rebecka Nomis, Emily Briggs and your petitioner of Rhinbeck in the county
of Dutchess, Ann Franklin of Mouisanna Westchester County, Lydia Cragin? of New York
City, Mary Winslow of Middletown Orange County, Edwin R Briggs of Brooklyn, George
Briggs of Milan Ulster County, and William Briggs, Richard Briggs, Julie Briggs,
Jacob Briggs, Abraham Briggs, Jane E. Briggs, children of Richard Briggs, deceased
all of the city of New York.
That your petitioner is desmons? that said last will and testament may be duly proved
and letters testamintary of duly issued by said Surrogate, and that such further or other
proceedings in the memoirs should be had as may be legal and ?.
Your petitioner therefore prays, that a citation may ? out of and under the seal of this
court to be directed to the proper persons instrument to the Statutes in such case made
and provided, ? them and each of them at such time and ? as shall be in said citation mentioned,
to appear and attend the probate if the last will and testament, and that such further and
other proceedings in the premises should be duly had as may be ? to be proving and
according of said last will and testament, and the granting probate and leters
testimtaring? ? of and your petitioner will pray & c
