Luther's will
I Luther H. Paine of the town of North East county of Dutchess and state of
New York, being mindful of my mortality, do this fourteenth day of May in the
year of our Lord one thousand eight hundred & fifty- make and publish this
my last will and testament in manner following
Item 1st- I direct my Executor here in after named to erect suitable monuments
at my grave
Item 2nd- I give and bequeath unto my beloved wife Prudence E. Paine ten hundred
& fifty dollars in lieu of dower and I also give her the Portraits made by
Ami Philips also my two best beds two bedsteads and all my bedding-my best-
carpet & floor oil cloth for the same one table cover--all my table linen &
towels -- The ten hundred & fifty dollars to be paid within one year after
my decease. the articles mentioned above to be paid as soon as it can be
conveniently done.
Item 3rd- I give and bequeath to my brother John L. Paine the sum of four
hundred and fifty dollars to be paid within one year after my decease.
Item 4th- I give and bequeath to my sister Chloe Philips the sum of four
hundred and fifty dollars to be paid within one year after my decease.
Item 5th- I give and bequeath to Harriet Paine daughter of my brother Manson Paine deceased
the sum of two hundred and fifty dollars to be paid within one year after my
decease or when she shall be 18 years of age.
Item 6th- I give and bequeath to the two children of my deceased sister Sally
M. Hedding each the sum of one hundred dollars to be paid within one year
after my decease--if they shall be 18 years of age & not otherwise
Item 7th- I give and bequeath to the only daughter of my deceased sister
Lucinda Armstrong the third choice in my feather beds. Straw ticks and bedsteads
to be paid as soon as it can conveniently be done after my decease
Item 8th- I give and bequeath all the residue of my property to the five
children of my sister Mary Ann Knickerbacker wife of Hugh Knickerbacker
to be divided equally among them when they shall be respectively eighteen
years of age
Item 9th- I hereby direct my executor hereafter named to put the money at
interest which may be due the Legators who are under eighteen years of age
and pay to them their said legacies and interest when they shall be respectively
of said age
Item 10th- I do hereby constitute and appoint Nicholas E. Eggleston of the
said town of North East to be the Executor of this my last will & testament
and I hereby revoke all former wills by me made
Item 11th- if either or both of the children of my said sister Sally M. Hedding
shall not be living at the age of eighteen years then their legacies shall
respectively be divided equally among the five children of my sister Mary
Ann Knickerbacker at the same time and in the same manner as directed in item
eighth.
In witness whereof I have hereunto set my hand and seal the day & year first
above written.

The above instrument consisting of but one sheet was now here subscribed by
Luther H. Paine the in the presence of each of us; and was at the same
time declared by him to be his last will & testament, and we, at his request,
signed our names here to as attesting witnesses
