BENJAMIN PAYNE

I, BENJAMIN PAYNE, of New York, being sick and weak. I direct all just debts and funeral charges to be paid. My executors, with the consent of my wife, may sell my negro slaves. I leave to my daughters, Anne and Sarah, £200 each when married. I leave to my wife Anne £300. "And I declare that it was my intention to have given the said £300 to my son James, but finding him to be refractory and disobedient, I have given it to his mother, that she may, or may not, as she pleases, give it to him in case his future behavior shall render him worthy." But I cannot help leaving this Testimony of affection even to a disobedient child, that in case he shall return to a dutiful behavior and becoming conduct in life, I request his mother to give him the said £300. I leave to my daughter Anne all that my dwelling-house and lot in Montgomerie Ward, where I now live, fronting Cherry street, and the lot of land thereto belonging, which extends down to Water street, Being about 16 feet in width, and being the westermost of my two adjoining houses and lots. I leave to my daughter Sarah the house and lot adjoining on the easterly side of the house and lot last mentioned, and which is also 16 feet wide, and fronts on Cherry street, and extends to Water street. I leave to my son Benjamin ½ of my water lot, lying opposite the above mentioned lots and is to be the north half, fronting Water street, being 30 feet wide and 100 feet long. I leave to my son John the southermost half of said lot, to extend into the river 100 feet. I also leave to my son John my house and lot in Montgomerie Ward, fronting Beekmans Slip, and now in possession of William Butler. I leave to my son Benjamin my house and lot in Montgomerie Ward, fronting Water street, on what is commonly called Cannon's Dock, and now in possession of Arthur McNiel, and adjoins on the rear upon land of Capt. Isaac Sears, being about 23 feet wide. I leave to my son James all that my store house and lot wharf and water lot, fronting the above last mentioned lot, and extending from Water street 200 feet into the river, being the same bredth. My under aged children are not to have their shares till of age. My wife is to have the use of the same for support of the children, and also the interest on the personal estate, and she is also to have £15 yearly for life. The rest of my personal estate to my wife for life, and then to my children. I make my wife Anne, and my good friend, Edward Laight, executors. Dated July 8, 1767. EPHRAIM PAINE

In the name of God, Amen. I, EPHRAIM PAINE, of Amenia Precinct, Dutchess County. I leave to my dearly beloved and faithful wife Mary, two beds such as she shall choose, with all the appurtenances and furniture thereto including two pair of linen sheets and two pair of woolen sheets to each bed; Also one of my horses, and two of my cows, and then of my sheep, and five of my swine, all such as she shall choose; Also my woman's saddle, one half of my other household furniture except beds; Also £200. To my beloved daughters, Elizabeth (FLINT), Mary (BARNUM), Sarah/Sally (BOYD), Chloe (MANN) and Lucy Paine (minor), each £50 respectively when eighteen. To my sons, Ephraim, Jr. and Abijah, all my farm in Amenia Precinct on which I now live, divided equally between them both to respect to quantity and quality as near as may be. To my above named five daughters that certain lot at a place called Whiteborough in Montgomery County, between the Cocquago branch of the Delaware and Susquehannah Rivers, containing 982 acres, known as lot number three, equally divided. To my two sons above named, 150 acres each out of lot No. six in said Whiteborough, and the remainder of lot No. six, except one fourth thereof which I have sold to Peter Garnsey, I give to my wife and my said five daughters; and if there should be any "surplussage" not disposed of in this will it is to be equally divided between my wife and my said sons and daughters. I appoint my beloved friend, Ezra Thompson and Peter Garnsey, Esq., and my wife Mary, my executors. Dated August 3, 1785. Witnesses, Ephraim Paine, Ssam Thompson, Rebekah King (widow) and Barnabas Paine. Proved, Dutchess County, October 27, 1785. Confirmed, New York, November 16, 1785.

JOHN PAINE

Will of JOHN PAINE, of the town of Southhold, in Suffolk County, mariner, being sick. "My executors are to sell the east part of my home lot where I now live, with the new house on it, with a line to run from the north of my lot to the street;" Also my Second lot of land lying near the inlet, being 50 acres, and 15 acres lying at ye Greate Swamp, and 36 acres lying on the north side of the town Pruchase of Lieutenant Griffing, Captain Herbert, and Thomas Gilbert; Also my sloop and my negro slaves, and two cows and 30 sheep. I leave to my wife Jemima all household stuff, and all my houses and lands not above disposed of (except my land in Hog Neck, and my two lots of Commonage) during her widowhood. I have to my son, Alsupp Paine, all my land in New Haven, Connecticutt. I leave to my son, John Paine, all my houses and lands in Southhold except as above, after my wife's decease. I leave to my son, Peter Paine, one lot of Commonage in Southhold, and another lot of Commonage to my daughter, Mary Corey. I leave to my daughter, martha Case, all my land and meadow on Hog Neck. I appoint my wife Jemima and my two sons in law, Abraham Corey and Henry Case, Jr., executors. Dated February 3, 1706/7. Witnesses, Nathan Landon, Jeremiah Vail. JOSHUA PAINE

I, JOSHUA PAINE, of Amenia, Dutchess County. All debts that I owe to any manner of person to be paid. I will that £6 be paid to my brother-in-law, Elisha, living on Long Island, it being a debt that he has no security for, and he living so remote from me that I have lacked opportunity to send it to him. And whereas I am somthing in debt, I will that my half right of land, which I bought of Beriah Kelle, lying in the Township of Pownal, supposed to be in the Province of New Hampshire, and also my one-fourth of a right of land lying at a place called Susquehanah, be sold to pay debts. And if not sufficient, then so much of my land in the Nine Partners to be sold as to pay the same. I leave to my wife Constance all my personal estate within doors, and one-half of the outdoor movables, and the improvement of all my lands and buildings where I now live while she remains my widow, and the right to take firewood and fencing from my two pieces of land. I leave to the children of my son, Ichabod Sparrow Paine, £30. I leave to my daughter, Rebecca Dyer, £18. To my daughter, Phebe Munro, one-half of my outdoor moveables. I leave to my son Barnabuas, after the death of my wife, all my lands and tenements, and he is to pay all legacies. I make my wife and son Barnabas, executors. Witnesses, Eunice Wheeler, Solomon Wheeler, Benjamin Doty. Dated Jun 16, 1774. Proved, October 6, 1775 before Bartholemew Crannell, Surrogate. Confirmed, October 13, 1778 by Thomas Tredwell, Judge of Court of Probate.

PETER PAIN

I, Peter Pain, of Southampton, Suffolk County, yeoman being weak in body. I leave my beloved wife Phebe, the use of my lands, meadows and buildings and moveables till my sons come of age, then the third part of said lands so long as she remains my widow; Also the best room in my house and £50. To my daughter Betsey, £30 when eighteen, to my duaghter Elizabeth, a good milch cow when she receives her legacy. To my four sons, Daniel, Zaccheus, Rufus and Nichols all my lands and buildings, the lands to be divided according to qunatity and quality, but he that has the buildings must pay each of the others one fourth of what they shall be prized at to help them towards procuring buildings for themselves. The land I bought of Walter Havens to be sold and the money used to pay my just debts. I likewise give my daughter Betsey a right in my house so long as unmarried. I make my wife Phebe, and my friend, Abraham Rose, executors. Witnesses, Jonathan Pain, Paul Pain and Sam. H. Rose. Proved, September 4, 1784, Suffolk County. Confirmed, New York, October 19, 1784.

THOMAS PAINE

I, THOMAS PAINE, of Southhold, in Suffolk County, being weak in body. I leave to my wife Abigail the house where I now dwell and the land adjoining, bounded south by a road, east by land of Samuel Cox, north and west by land of widow Abigail Benjamin, reserving my house and shop on the southwest corner, and ½ acre of land from Benjamin's corner, being 8 rods on the east side and 10 rods on the north side. After my son, Benjamin Paine, is of age, he is to have half of my house and land. My executors are to sell all the rest of my estate immediately after my decease, and, after debts are paid, the rest to my 5 children, Daniel, Samuel, Mary, Thomas, and Olive. I make John Wickham and Daniel Osborn, Jr., executors. Witnesses, Thomas Goldsmith, Joseph Reeve, Parker Wickham. Proved, November 4, 1766

I leave to my sons William and Isaac, all my land at Hog Neck Spring, and £30. The land is bounded south by Elisha Howell, west and north by water, and east by highway. I leave to my duaghter Sarah, £15, a bed. To my duaghter Elizabeth, £18, and a bed and looking-glass. I make Thomas Sandford, Jr., executor. Witnesses, John Terbell, Jonathan Paine, John Lester. Dated April 10, 1742. Proved October 12, 1742.
